Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the Format Pilates website, studio, classes, private sessions, memberships, packages, events, and related services (collectively, the "Services"). By accessing the website, creating an account, purchasing or booking a Service, or participating in a class or session, you agree to these Terms and all policies incorporated by reference. 

​

If you do not agree, do not use the Services. A separate signed client agreement, health-studio contract, informed-consent form, or liability waiver may also apply. If there is a conflict, mandatory law controls, followed by the signed agreement, then these Terms, unless the signed agreement expressly states otherwise. 

​

1. Eligibility and Accounts 

You must be at least 18 years old and legally able to enter into a contract to purchase Services for yourself. A parent or legal guardian must complete all required registration, consent, and waiver documents for an eligible minor. 

​

You agree to provide current, complete, and accurate information and to keep your account credentials secure. You are responsible for activity under your account and must notify us promptly of suspected unauthorized use. Purchases, credits, and memberships are personal and may not be transferred, shared, resold, or used by another person unless Format Pilates approves the transfer in writing. 

​

2. Health, Safety, and Fitness Disclaimer 

Pilates and other fitness activities involve physical exertion and inherent risks, including falls, strains, sprains, equipment-related injuries, aggravation of existing conditions, serious injury, and, in rare cases, death. 

​

Before participating, you are responsible for determining whether the activity is appropriate for you and for consulting a qualified healthcare professional when needed, including if you are pregnant, postpartum, recovering from surgery or injury, taking medication that may affect exercise, or living with a medical condition. Format Pilates instructors do not diagnose, treat, or provide medical advice.

You agree to: 

  1. Disclose relevant injuries, conditions, pregnancy, symptoms, and physical limitations before class or as they arise. 

  2. Follow instructor directions and all studio and equipment-safety rules. 

  3. Use equipment only as instructed. 

  4. Stop immediately and notify the instructor if you feel pain, dizziness, shortness of breath, faintness, or other unusual symptoms. 

  5. Avoid participating while impaired by alcohol, cannabis, drugs, or any substance that could make exercise unsafe. 

​

Instructors may offer general modifications but cannot guarantee that a class or modification is appropriate for every person. Format Pilates may refuse or discontinue participation when reasonably necessary for safety. 

​

3. Bookings, Cancellations, and No-Shows 

Booking is recommended and may be required. Space is limited and is not guaranteed until a reservation is confirmed. 

  1. A reservation canceled at least 6 hours before the scheduled start time will be treated as an on-time cancellation, and the class or session credit will be returned when permitted by the applicable purchase. 

  2. A cancellation made less than 6 hours before the start time is a late cancellation. 

  3. A failure to attend without canceling is a no-show. 

  4. Late cancellations and no-shows may result in loss of the class or private-session credit. Unlimited-membership clients may instead be charged a fee of $15 for late cancellation and $20 for no-show. 

  5. Private-session cancellation rules may be listed in the private-session agreement or purchase description. If no separate rule is displayed, the cancellation window above applies.

Cancellation is complete only when submitted through Momence or confirmed by Format Pilates through +1 (424) 209-9010. Social-media messages are not an approved cancellation method unless we confirm otherwise in writing. 

​

4. Waitlists, Late Arrival, and Class Changes 

Waitlisted clients may be automatically added to a class when a space becomes available, according to the booking platform settings disclosed at signup. You are responsible for monitoring notifications and removing yourself from a waitlist if you can no longer attend. 

​

Please arrive on time. For safety and to minimize disruption, clients who arrive after class begins may be denied entry and treated as a late cancellation or no-show. New clients should arrive 10 minutes early for orientation. 

​

Format Pilates may substitute instructors, change class formats, adjust schedules, cancel classes, or temporarily remove equipment from service when reasonably necessary. If Format Pilates cancels a booked class or private session, the affected credit will be returned or the session rescheduled. Reasonable changes to class types, quantities, instructors, equipment, or schedules do not guarantee a refund except where required by law. 

​

5. Purchases, Packages, and Expiration 

Prices, included Services, expiration dates, and other purchase terms are shown at checkout or in the applicable purchase agreement. 

​

  1. The 5-Class Pack expires 60 days after purchase. 

  2. Private Pilates is available as a single session or in 4-, 8-, and 12-session packages. Private-session packages expire 60 days after purchase. 

  3. The Founding Unlimited Membership includes up to one eligible group class per day, subject to availability, booking rules, excluded services, and late-cancellation or no-show policies. 

  4. The 8-Class Membership includes eight eligible group-class credits during each monthly billing cycle. Unless the checkout page or signed agreement states otherwise, unused monthly credits expire at the end of the billing cycle and do not roll over. 

  5. The 4-Class Membership includes four eligible group-class credits during each monthly billing cycle. Unless the checkout page or signed agreement states otherwise, unused monthly credits expire at the end of the billing cycle and do not roll over. 

​

Expiration dates are not extended for nonuse, scheduling preferences, travel, illness, or personal circumstances except where required by law or expressly approved by Format Pilates in writing. Promotional offers may have separate restrictions disclosed at purchase. 

 

6. Memberships and Automatic Renewal 

Recurring memberships automatically renew, and the payment method on file will be charged at the price and frequency clearly disclosed at enrollment until you cancel. Before enrollment, you will be shown the recurring price, billing frequency, renewal terms, minimum commitment if any, and cancellation method, and we will obtain your affirmative consent as required by law. 

​

Memberships require a two-month minimum commitment and are subject to the applicable Membership Terms. You may submit a cancellation request at any time through Momence or by emailing hello@formatpilatessb.com. If you enrolled through another method, you may also cancel through the same medium or another easy-to-use method we make available.

​

Cancellation will take effect after the two-month minimum commitment has been fulfilled and will stop future renewal charges. Cancellation does not generally provide a refund for the current billing period or waive charges due during the initial commitment period. To avoid an additional renewal charge after completing your commitment, please cancel before your next scheduled billing date.

​

Unless your purchase agreement expressly provides otherwise, membership access continues through the end of the already-paid billing period. Any minimum commitment, early-cancellation term, founding-rate consequence, or freeze option must be clearly disclosed in the applicable membership agreement before purchase. 

​

If we make a material change to recurring terms or pricing, we will provide advance notice and cancellation information as required by law. We will provide legally required renewal reminders and maintain records of consent. 

​

Canceling reservations is not the same as canceling a membership. Deleting an app, removing a payment card, or failing to attend does not cancel a membership. 

​

7. California Health-Studio Contract Rights 

If your purchase is a contract for health-studio services under California law, you receive all nonwaivable cancellation and refund rights provided by the California Health Studio Services Contract Law, including applicable cooling-off, disability, death, relocation, delayed-opening, and material-reduction rights. Nothing in these Terms limits those rights. 

​

Your health-studio contract must be provided in writing and contain the notices and information required by law, including the operator's name, mailing address, email address, contract date, services, facilities, access information, and the applicable statutory cancellation notice. These website Terms do not replace that signed contract. 

​

8. Payments and Billing 

You authorize Format Pilates and its payment processor to charge the payment method you provide for purchases, recurring membership fees, approved late-cancellation or no-show fees, taxes, and other charges disclosed before they are incurred. 

​

You are responsible for maintaining a valid payment method. Failed or reversed payments may result in account suspension and reasonable returned-payment or collection costs disclosed in advance and permitted by law. Prices may change prospectively. The total price and mandatory fees will be disclosed before purchase as required by law. 

​

9. Refunds and Credits 

Purchases are subject to the Format Pilates Refund Policy, which is incorporated into these Terms. Except as stated in that policy, a signed agreement, or applicable law, purchases are final, nonrefundable, and not redeemable for cash. 

​

10. Studio Conduct 

Clients and guests must behave respectfully toward instructors, staff, and other clients; use equipment properly; maintain appropriate personal hygiene and attire; and follow posted studio rules. Harassment, discrimination, threats, intimidation, unsafe conduct, property damage, unauthorized instruction or solicitation, and disruptive behavior are prohibited.

Format Pilates may refuse service, remove a person from the premises, suspend an account, or terminate Services for unsafe or unlawful conduct, nonpayment, repeated policy violations, abuse of staff or clients, or material breach of these Terms, subject to applicable law and any refund rights. 

​

11. Personal Property 

You are responsible for personal belongings brought to the studio. To the fullest extent permitted by law, Format Pilates is not responsible for loss, theft, or damage to personal property unless caused by its legally actionable conduct. 

​

12. Photography, Recording, and Publicity 

Clients may not photograph, record, livestream, or publish images or audio of instructors, staff, or other clients without permission. Format Pilates will obtain appropriate consent before using an identifiable client's image, voice, testimonial, or likeness for promotional purposes. Consent may be withdrawn prospectively in writing, but withdrawal will not require removal of materials already lawfully produced or distributed where removal is not reasonably practicable.

13. Intellectual Property 

The website and its text, graphics, logos, photographs, videos, class names, designs, and other content are owned by or licensed to Format Pilates and are protected by applicable intellectual-property laws. You may use the website for personal, noncommercial purposes only. You may not copy, modify, distribute, sell, exploit, scrape, or create derivative works from our content without written permission. 

​

14. Third-Party Services and Links 

The Services may rely on or link to third-party booking, payment, map, social-media, or other platforms. Format Pilates does not control and is not responsible for third-party services, availability, content, security, or policies. Your use of those services may be governed by separate terms. 

​

15. Disclaimers and Limitation of Liability 

The website and Services are provided on an "as available" basis to the fullest extent permitted by law. We do not guarantee uninterrupted website or booking-platform access, a particular fitness result, or the availability of a specific instructor, class, time, or piece of equipment. 

​

To the fullest extent permitted by law, Format Pilates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or Services. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability based on gross negligence, recklessness, intentional misconduct, or other nonwaivable rights. Any separate liability waiver is subject to applicable law.

16. Suspension and Termination 

You may stop using the website at any time and may cancel a membership as described above. Format Pilates may suspend or terminate access for a material breach of these Terms, nonpayment, fraud, safety concerns, or unlawful conduct. Termination does not eliminate obligations or rights that arose before termination. 

​

17. Governing Law and Disputes 

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be brought in a court of competent jurisdiction in the county where Format Pilates' principal studio is located, unless applicable law requires otherwise. 

​

Before filing a claim, you and Format Pilates agree to make a good-faith effort to resolve the issue by written notice describing the dispute and requested resolution. This paragraph does not prevent either party from seeking urgent relief or exercising a right that cannot legally be limited. 

​

18. Changes to These Terms 

We may update these Terms prospectively. The updated Terms will be posted with a revised effective date. Material changes affecting an existing recurring membership will be communicated as required by law. Changes will not retroactively reduce rights already earned. 

​

19. General Terms 

If any provision is found unenforceable, the remaining provisions will continue to apply. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent. Headings are for convenience only.
